Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Zipilot platform operated by Zipilot LLC (“Zipilot,” “we,” or “us”). By creating an account or using the platform, you agree to these Terms.

1. The service

Zipilot provides an AI assistant that answers customer messages, identifies potential customers, books appointments, and passes conversations to your team through the channels you connect. You are responsible for keeping the information you upload accurate and for how your connected channels are used.

2. Your account

You must be at least 18 years old and authorized to accept these Terms on behalf of the business you represent. You are responsible for protecting your login credentials and for all activity on your account.

3. Acceptable use

By using Zipilot, you agree not to do the following.

  • Send unsolicited messages or spam.
  • Violate the WhatsApp Business Policy, TCPA, CAN-SPAM, or any other applicable communications regulation.
  • Upload content you do not have the right to use.
  • Attempt to reverse engineer, resell, or abuse the platform.

4. Customer data

The business information and customer conversations you submit to the platform remain yours. We explain how we handle that data in our Privacy Policy.

5. Fees and billing

Paid plans are billed in advance through Stripe, every month or every year. Fees are not refundable unless the law requires it. You can cancel at any time. Your access continues until the end of the period you paid for.

6. Service availability

We work to keep the service available, but we do not guarantee it will run without interruptions. We may carry out maintenance, updates, and changes. If a material change negatively affects you, we will give you reasonable notice.

7. Channels from other providers

When enabled, some features may connect to services from other providers, such as WhatsApp, Google Calendar, Calendly, Boulevard, or Stripe. Those services have their own terms. Zipilot is not responsible for their availability, policies, or decisions.

8. Disclaimers and liability

The platform is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, Zipilot is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or revenue. Our total liability for any claim is limited to the amount you paid during the twelve months before the event giving rise to the claim.

9. Closing your account

You can close your account at any time. We may suspend or close accounts that violate these Terms, applicable law, or the policies of channels from other providers. When an account is closed, we delete its data as described in the Privacy Policy.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware.

11. Changes

We may update these Terms as the platform changes. We will email account holders about material changes. If you keep using the platform after those changes take effect, you accept the updated Terms.
